The driver being accused of hitting a 12-year-old while walking with her mother on the side of the road last week near Williamsburg is moving towards trial. He was charged back in August.
Jason Lemieux was arraigned Monday morning on two counts of operating while intoxicated causing serious injury.
The 12-year-old remains in critical condition at the Devos Children's Hospital in Grand Rapids on Tuesday. Her mother, Bonnie Babcock is in fair condition at Munson Medical Center.
The accident happened around 9:15 p.m. at the intersection of Cook Rd. and Old M-72. Lemieux is accused of drunk driving and hitting the 12-year-old girl.
The mom was also hit, but by a second driver, while she was trying to help her daughter.
Family members tell 7&4 News that the girl is suffering from a serious pelvis injury and that the mother has a neck injury.
According to the Grand Traverse County Prosecutor, Bob Cooney, there may be additional charge against Jason Lemieux of driving while intoxicated with a person under 16. At the time of the incident, Lemieux had an 8-year-old in his car.
Lemieux's preliminary hearing is scheduled for Sept. 8.
