ISABELLA COUNTY, Mich., (WPBN/WGTU) -- A northern Michigan man accused of watching child pornography in public is now heading to the federal court system.

Timothy Powers, 38, was arrested in April after investigators said he was watching child porn on demo computers at the Walmart in Mount Pleasant.

The charges against Powers, two counts of child sexually abusive material, have been dropped out of Isabella County, due to the federal case.

In a criminal complaint against Powers, a FBI special agent said Powers admitted to looking at 30 or more underage nude photos on the computers.

On May 18, a federal judge in Bay City filed a competency hearing for Powers.

According to court records Powers was indicted by a grand jury on federal charges of certain activities relating to material constituting or containing child pornography on May 23.

Powers is already on the sex offender registry after a 2011 conviction for fourth-degree criminal sexual conduct in Calhoun County.
