The man accused of shooting a Ludington Police Officer last summer turned down a plea agreement in court Wednesday.
Lowell Fetters was in court for a competency hearing and final conference.
While in court, the judge ruled that he was in the right mental state to stand trial.
Police said Fetters shot Sergeant David Maltbie back on June 26th during a domestic violence situation.
Maltbie was shot near his neck but did survive.
Since Fetters turned down the agreement, the case will go to trial. That is currently scheduled to start in December.
