A Benzie County judge decided that 45-year-old Kelli Stapleton will keep her rights as a parent for now.
The Department of Human Services wanted to take away Stapleton's rights as a parents as a way to protect her three kids.
The judge said that it was too early for that decision to be made and dismissed the case. The judge said the children are in a stable home with their father, Matt, and he did not see a need for the department to do regular checks.
Stapleton is accused of trying to kill herself and her 14-year-old daughter Isabelle in September. She is now charged with attempted homicide.
Stapleton is expected to be back in court on October 10.
