      Settlement in abuse lawsuit against the state of Michigan

      The state of Michigan has agreed to pay $145,000 to settle a lawsuit by a man who said he was the victim of excessive force at a home for the disabled in Isabella County.

      The state of Michigan has agreed to pay $145,000 to settle a lawsuit by a man who said he was the victim of excessive force at a home for the disabled in Isabella County.

      The settlement was reached this week in Detroit federal court.

      There was no dispute that Matthew McGuire, who is mentally ill, suffered broken ribs and bruises at the Mount Pleasant Center, which was run by the state until 2009. The issue was how the injuries occurred.

      The state says McGuire had to be restrained at times and any force was used in good faith. The lawsuit was dismissed at one point, but an appeals court revived it in May, saying Judge George Caram Steeh improperly excluded evidence.

      McGuire was represented by Alyson Oliver and Daniel Gustafson.
