CHARLEVOIX COUNTY, Mi. (WPBN/WGTU) -- A man will spend time behind bars after a drunk driving arrest escalated into an officer-involved shooting.
Jared Martin was sentenced Friday to 180 days in jail after pleading guilty to police officer assault/resisting/obstructing as well as operating while intoxicated.
The incident happened back in October on See Road in Hayes Township.
Jared Martin was being arrested for drunk driving when his dad, Steve, allegedly tried to hit a deputy with his vehicle.
But when police say Jared didn't cooperate, things quickly got out of hand and police tried to taze Jared.
That's when police say Steve drove toward the situation in his truck and shots were fired. Steve was hit in the arm.
"He was shot while engaging the deputies," said Michigan State Police Lt. Derrick Caroll. "[He was] trying to run them over with his vehicle during the course of the assault."
Steve's attorney says they are sticking to the statement that he was only trying to protect his son.
"He had to urinate and ya know he just didn't want to pee his pants right there on the spot," Steve Martin said. "He just wanted to go to the bathroom and then he would have gone off to jail and he knew that's what was gonna happen."
When Jared made a move to relieve himself, Steve says police tazed his son. Steve claims he was going to move the car to protect his son from traffic.
"They just made a bad judgement call," Steve said. "I probably made a bad judgment call by moving the truck. But I didn't run over the officers and their claiming that I had the intent to do bodily harm and kill an officer. That's not what happened."
Michigan State Police say Steve Martin has a criminal record and will be treated as a habitual offender.
Steve Martin is scheduled to be back in court for a pretrial on March 14.
